Why VIC public holidays make a break cheaper

Under section 89 of the Fair Work Act, if a public holiday falls inside a period of paid annual leave you are taken to be on the public holiday, not on leave. The day is paid and it is not deducted from your balance. So the same week off costs you fewer hours when it contains a holiday.

Victoria has 14 full-day public holidays in 2026, and 10 of them fall on a weekday, which is when a holiday actually saves you leave. A holiday landing on a Saturday or Sunday you never work saves you nothing.

The one thing people get wrong. Annual leave loading is not part of the NES and is not a VIC entitlement either. The 17.5% only applies if your award or enterprise agreement provides it, and where an award provides both a loading and shift penalties you get the higher of the two, not both. Annual leave and long service leave are separate in VIC

Annual leave comes from the federal Act. Long service leave does not: it comes from the Long Service Leave Act 2018 (VIC), administered by Wage Inspectorate Victoria. The two accrue at the same time and neither reduces the other.

In Victoria the full long service entitlement is 1 week for every 60 weeks of continuous employment, which is 6.07 weeks at 7 years, and a pro-rata payout starts at 7 years, which is enough on its own. Full detail on VIC long service leave.

What does not change because you work in VIC

It is worth being explicit, because plenty of pages imply otherwise. The 4-week entitlement, the accrual rate of your ordinary weekly hours divided by 13, the rule that unused annual leave is always paid out when you leave under s.90, and the cash-out rules under ss.92 to 94 are all federal and identical in every state and territory. How much long service leave do I get in VIC?
6.07 weeks after 7 years of continuous service with the same employer, under the Long Service Leave Act 2018 (VIC). Pro-rata payout becomes available after 7 years on termination. Calculate your VIC LSL
When does VIC long service leave become payable on termination?
Pro-rata payout is available after 7 years of continuous service in VIC however the employment ends, including a plain resignation. Under the Long Service Leave Act 2018 the only exclusion is dismissal for serious or wilful misconduct. VIC is one of the minority of states where the threshold alone is enough.
What's the VIC pro-rata LSL formula?
VIC uses the 1/60th formula: weeks of LSL = total weeks of service divided by 60. So 7 years of service equals (7 × 52) ÷ 60 = 6.07 weeks. The longer you stay, the more leave accrues, with no cap.
How is annual leave calculated in Australia?
FT employees accrue 4 weeks (152 hours) per year, about 2.923 hrs/week. PT employees accrue pro-rata. Casuals don't accrue paid annual leave; they receive 25% loading instead.
How many days is 100 hours of annual leave?
12.5 days based on an 8-hour workday. If your standard day is 7.6 hours (38-hr week ÷ 5 days), 100 hours equals 13.16 days.
What is annual leave loading and who gets it?
17.5% on top of base pay when annual leave is taken. Compensates for the loss of overtime and penalty rates while on leave. Eligibility depends on your modern award.
Can my employer force me to take annual leave?
In limited cases, yes. If your balance is "excessive" (typically 8+ weeks accrued), or during a planned shutdown, employers can direct you to take leave with reasonable written notice.
