How much long service leave do I get in ACT?

When does ACT long service leave become payable on termination?
Pro-rata payout is available after 5 years of continuous service in most circumstances. Earlier pro-rata may apply on death, illness, retrenchment or harassment-related termination, depending on the specific provisions of the Long Service Leave Act 1976. Resignation typically triggers payout once the 5-year mark is reached.
What's the ACT pro-rata LSL formula?
ACT uses the 1/60th formula: weeks of LSL = total weeks of service divided by 60. So 7 years of service equals (7 × 52) ÷ 60 = 6.07 weeks. The longer you stay, the more leave accrues, with no cap.
Do ACT casuals get long service leave?
Yes, where employment has been "regular and systematic" over the qualifying period. A casual working consistent shifts for 7 years has the same ACT LSL entitlement as a permanent employee. Casual loading does not exclude LSL eligibility under the Long Service Leave Act 1976.
How many public holidays does ACT have in 2026?

Does ACT substitute public holidays that fall on weekends?
Yes. When a public holiday falls on a Saturday or Sunday in ACT, the state government typically gazettes the following Monday as a substitute. The Fair Work Act 2009 (s.115) recognises substitute days, and penalty rates apply on the substitute, not the calendar date.
Is annual leave different in ACT?
No. Annual leave (4 weeks for FT/PT under NES s.87) is identical Australia-wide because it's federal. ACT only differs in the layered entitlements: long service leave (Long Service Leave Act 1976 (ACT)) and the gazetted public holidays calendar.
What law governs long service leave in ACT?
The Long Service Leave Act 1976 (ACT) is the source of LSL entitlements for most Australian Capital Territory employees. It sits alongside (and is preserved by) the National Employment Standards. Federal awards may include LSL provisions for specific industries (e.g. coal mining, security), in which case those override the state Act.
