Set by Fast Food Industry Award 2020 (MA000003) and the NES.
Where this award goes beyond, or sits at, the NES floor.
Standard NES floor of 4 weeks per year of full-time service. Pro-rata for part-time.
Day workers get the greater of 17.5% or the weekend penalty rates they would have earned during the leave, not both. This award has no shiftwork provisions. Run the numbers in the annual leave loading calculator.
No formal RDO accrual cycle in this award. Time off in lieu of overtime (TOIL) may still be available.
The Fast Food Award sets your pay rates, but your paid leave runs on the National Employment Standards. Work out 4 weeks of holidays with the annual leave calculator, and your 10 days of paid sick and carer's leave with the personal leave calculator. To confirm which award applies to you and how it lifts entitlements above the NES floor, read our guide to modern awards.
Casuals under this award who want to become permanent use the employee choice pathway, which replaced casual conversion in 2024. See casual conversion and what replaced it for the 6 month rule, the 21 day employer response and the three grounds for refusal.
The Fast Food Award (MA000003) is the common name for the Fast Food Industry Award 2020. Industries, work types and exclusions are taken from the Fair Work Ombudsman summary.
Notes & exclusions. Covers employees who deliver meals to customers, including on-hire employees (clauses 4.2, 4.3 and 12.4). Coffee shops, cafes, bars and restaurants that mainly provide sit-down service are excluded (clause 4.2(c)). Stand-alone restaurants and cafes are usually covered by the Restaurant Award, and those run as part of a hotel by the Hospitality Award. Public holiday penalty is 225% for full-time and part-time employees, the same as the Hospitality Award; the 250% figure often quoted is the casual-inclusive rate. Sunday is 125% for Level 1 and 150% for Levels 2 and 3. Night work is 110% between 10.00pm and midnight and 115% between midnight and 6.00am.
Each classification has its own pay grade. Use the FWO Pay Calculator for current dollar rates.
