What are you paid for working a public holiday?

Public holiday penalty rates come from your award, not the NES, and vary widely. Customer-facing awards such as the General Retail Award, Fast Food Award, Hospitality Award, Restaurant Award, Registered Clubs Award and Hair and Beauty Award each set their own public holiday loading, commonly between 200% and 250% of the base rate. Under the NES you are entitled to a paid day off unless your employer makes a reasonable request to work. Regional public holidays: the ones that only apply to some workers

Not every Australian public holiday applies statewide. Queensland gazettes the Ekka for the Brisbane area only, the Northern Territory runs five separate town show days including Darwin Show Day, and Tasmania has nine regional holidays set by municipal area, among them the Royal Hobart Regatta in the south and the Royal Launceston Show in the north. The ACT has Canberra Day, which exists nowhere else, and Victoria gazettes Melbourne Cup Day statewide but lets non-metropolitan councils substitute a local holiday instead. Victoria also stops for the football: the Friday before the AFL Grand Final is the only Australian public holiday whose date is set by a sporting fixture.

The test that decides whether one of these applies to you is the place where you are based for work purposes, not where you live, so a commuter can be entitled to a holiday that does not apply in their own suburb. Public holidays in other years and long weekends

The dates move each year because several holidays are gazetted to a weekday or substituted when they fall on a weekend. The confirmed calendar for the following year is on public holidays 2027, and the dates that combine with a weekend are listed on long weekends in Australia. Taking annual leave around a public holiday does not consume that day: a public holiday falling inside a period of annual leave is paid as a public holiday, not deducted from your balance, as explained on the annual leave calculator.

How many public holidays are there in Australia?
7 days are nationally recognised: New Year's Day, Australia Day, Good Friday, Easter Monday, Anzac Day, Christmas Day and Boxing Day. Every state and territory gazettes additional days, taking the total per state from 9 (TAS) to 15 (ACT) in 2026.
Do I get penalty rates for working a public holiday?
Almost always yes, the rate depends on your award. Most awards pay 200%-250% (i.e. 2-2.5x base rate) for hours worked on a gazetted public holiday. A small number absorb public-holiday work in an annualised salary instead. Calculate your public holiday pay
Can I refuse to work on a public holiday?
Yes, under s.114 of the Fair Work Act. You can refuse a request to work a public holiday if the request is unreasonable or your refusal is reasonable. Factors include the work's nature, your personal circumstances, the type of employment and notice given.
What happens when a public holiday falls on a weekend?
Most states gazette a substitute weekday (usually the following Monday). The substitute IS the public holiday for legal purposes, penalty rates apply on the substitute, not the calendar date. Some states gazette both days for Anzac Day and Boxing Day.
Do casuals get paid public holidays?
Casuals don't get paid for public holidays they don't work. If they DO work a public holiday, they get the public-holiday penalty rate (which already includes their casual loading) under their award.
Does annual leave include public holidays?
No, public holidays don't come out of your annual leave balance. If a public holiday falls during your annual leave, that day is paid as a public holiday and your annual leave is extended/preserved by one day.
