Long service leave is the one entitlement Queensland sets for itself. Under the Industrial Relations Act 2016 (QLD) you reach 8.67 weeks at 10 years, with a pro-rata payout available from 7 years, worked out on QLD long service leave. Whether that pro-rata amount is actually paid depends on why the job ended, which differs by state and is set out in pro-rata long service leave. Queensland also gazettes 13 public holidays in 2026, listed with penalty rates on QLD public holidays.

Everything else comes from the National Employment Standards and is identical in every state: 4 weeks of annual leave, 10 days of personal and carer's leave, unpaid parental leave, and redundancy pay on the section 119 scale. How much long service leave do I get in QLD?
8.67 weeks after 10 years of continuous service with the same employer, under the Industrial Relations Act 2016 (QLD). Pro-rata payout becomes available after 7 years on termination. Calculate your QLD LSL →
When does QLD long service leave become payable on termination?
Reaching 7 years of continuous service is necessary but not sufficient in QLD. Under the Industrial Relations Act 2016 a pro-rata payment before the full 10-year entitlement also requires a qualifying reason: illness, incapacity, a domestic or other pressing necessity, reaching retirement age, death, or termination by the employer for something other than serious misconduct. A plain resignation to take another job can pay nothing. Once you reach 10 years the entitlement is payable however you leave.
What's the QLD pro-rata LSL formula?
QLD grants 8.67 weeks at the 10-year trigger, which works out to ~0.867 weeks per year of service. After 7 years on termination you'd be entitled to roughly 6.07 weeks pro-rata.
Do QLD casuals get long service leave?
Yes, where employment has been "regular and systematic" over the qualifying period. A casual working consistent shifts for 10 years has the same QLD LSL entitlement as a permanent employee. Casual loading does not exclude LSL eligibility under the Industrial Relations Act 2016.
How many public holidays does QLD have in 2026?

Does QLD substitute public holidays that fall on weekends?
Yes. When a public holiday falls on a Saturday or Sunday in QLD, the state government typically gazettes the following Monday as a substitute. The Fair Work Act 2009 (s.115) recognises substitute days, and penalty rates apply on the substitute, not the calendar date.
Is annual leave different in QLD?
No. Annual leave (4 weeks for FT/PT under NES s.87) is identical Australia-wide because it's federal. QLD only differs in the layered entitlements: long service leave (Industrial Relations Act 2016 (QLD)) and the gazetted public holidays calendar.
What law governs long service leave in QLD?
The Industrial Relations Act 2016 (QLD) is the source of LSL entitlements for most Queensland employees. It sits alongside (and is preserved by) the National Employment Standards. Federal awards may include LSL provisions for specific industries (e.g. coal mining, security), in which case those override the state Act.
