When does QLD long service leave become payable on termination?
Pro-rata payout is available after 7 years of continuous service in most circumstances. Earlier pro-rata may apply on death, illness, retrenchment or harassment-related termination, depending on the specific provisions of the Industrial Relations Act 2016. Resignation typically triggers payout once the 7-year mark is reached.
What's the QLD pro-rata LSL formula?
QLD grants 8.67 weeks at the 10-year trigger, which works out to ~0.867 weeks per year of service. After 7 years on termination you'd be entitled to roughly 6.07 weeks pro-rata.
Do QLD casuals get long service leave?
Yes, where employment has been "regular and systematic" over the qualifying period. A casual working consistent shifts for 10 years has the same QLD LSL entitlement as a permanent employee. Casual loading does not exclude LSL eligibility under the Industrial Relations Act 2016.

Does QLD substitute public holidays that fall on weekends?
Yes. When a public holiday falls on a Saturday or Sunday in QLD, the state government typically gazettes the following Monday as a substitute. The Fair Work Act 2009 (s.115) recognises substitute days, and penalty rates apply on the substitute, not the calendar date.
Is annual leave different in QLD?
No. Annual leave (4 weeks for FT/PT under NES s.87) is identical Australia-wide because it's federal. QLD only differs in the layered entitlements: long service leave (Industrial Relations Act 2016 (QLD)) and the gazetted public holidays calendar.
What law governs long service leave in QLD?
The Industrial Relations Act 2016 (QLD) is the source of LSL entitlements for most Queensland employees. It sits alongside (and is preserved by) the National Employment Standards. Federal awards may include LSL provisions for specific industries (e.g. coal mining, security), in which case those override the state Act.
