When does TAS long service leave become payable on termination?
Pro-rata payout is available after 7 years of continuous service in most circumstances. Earlier pro-rata may apply on death, illness, retrenchment or harassment-related termination, depending on the specific provisions of the Long Service Leave Act 1976. Resignation typically triggers payout once the 7-year mark is reached.
What's the TAS pro-rata LSL formula?
TAS grants 8.67 weeks at the 10-year trigger, which works out to ~0.867 weeks per year of service. After 7 years on termination you'd be entitled to roughly 6.07 weeks pro-rata.
Who is entitled to long service leave?
Almost every Australian employee with sufficient continuous service. Rules vary by state, typically 10 years for full entitlement, with pro-rata available earlier on termination.
Do casuals get long service leave?
In most states yes, if their service has been "regular and systematic." Casuals working consistent hours over the qualifying period have the same LSL entitlement as permanent employees.
Can long service leave be cashed out?
No. Unlike annual leave, LSL cannot be cashed out while employed. It must either be taken as leave or paid out on termination.
