Coverage

Who this award covers.

The Miscellaneous Award (MA000104) is the common name for the Miscellaneous Award 2020. Industries, work types and exclusions are taken from the Fair Work Ombudsman summary.

Industries

  • industries with no other modern award coverage
  • on-hire and labour hire
  • group training services

Work types

  • work not covered by any other modern award
  • trade qualified work
  • advanced trade work
  • sub-professional work
  • on-hire work
  • apprentices and trainees hosted through group training services

Notes & exclusions. The residual award. It covers employers and employees only where no other modern award applies, so it is the fallback for odd jobs that fit no industry award, and it deliberately excludes managerial staff and professional employees such as accountants and finance, marketing, legal, HR, public relations and IT specialists. The classification ladder is unusually short and is driven by tenure rather than duties at the bottom: Level 1 applies only for the first 3 months of employment, after which the employee must move to Level 2. Level 1 sits below the National Minimum Wage because it is the C14 entry rate, which the Fair Work Commission preserves as a short-term entry-level rate rather than a rate for ongoing employment. Saturday is a flat 120% with no split, ordinary hours run 7am to 7pm Monday to Friday with 120% outside that window, Sunday is 150% and public holidays are 250% for permanents and casuals alike: the casual loading is not added on a public holiday, and it is not paid on overtime either. The award has no shift loadings at all.
