Set by Pest Control Industry Award 2020 (MA000097) and the NES.
Where this award goes beyond, or sits at, the NES floor.
A 7 day shiftworker who is regularly rostered to work on Sundays and public holidays gets the extra week of annual leave for shiftworkers under the NES (clause 23.2). Their excessive leave accrual threshold is 10 weeks instead of 8 (clause 23.6(a)).
Day workers are paid what they would have earned for their ordinary hours, AND a flat 17.5% loading on top. Shift workers are paid what they would have earned for their ordinary hours, AND the greater of 17.5% or their shift penalty on top. This award adds the pay and the loading rather than paying the greater of them. The 17.5% is calculated on your minimum hourly rate plus the leading hand and first aid allowances where they apply (clause 23.3(b)). Run the numbers in the annual leave loading calculator.
By agreement, ordinary hours can be worked as a 19 day, 4 week cycle of 8 hour days with a rostered day off in each cycle (clause 14.1(a)). An employer and a majority of employees can agree to more than one RDO a cycle, with up to 10 ordinary hours a day (clause 14.1(b)). An RDO that falls on a public holiday moves to the next working day, or to another day by agreement (clause 14.4).
The Pest Control Award sets your pay rates, but your paid leave runs on the National Employment Standards. Work out 4 weeks of holidays with the annual leave calculator, and your 10 days of paid sick and carer's leave with the personal leave calculator. To confirm which award applies to you and how it lifts entitlements above the NES floor, read our guide to modern awards.
The Pest Control Award (MA000097) is the common name for the Pest Control Industry Award 2020. Industries, work types and exclusions are taken from the Fair Work Ombudsman summary.
Notes & exclusions. Weekend work is ordinary time under this award, not overtime. A day worker can work ordinary hours on any day from Monday to Sunday between 6.00am and 6.00pm (clause 13.2(c)), so Saturday is paid 150% with a 3 hour minimum and Sunday 200% with a 4 hour minimum (clause 21.1). A public holiday is 250% with a 4 hour minimum (clause 21.2). Shiftworkers get 115% on an afternoon shift, 120% on a night shift and 125% on a night shift that does not rotate or alternate with another shift or day work (clauses 22.2 to 22.4), but a shift loading is not paid on top of an overtime, weekend or public holiday rate (clause 22.5). Overtime is 150% for the first 2 hours and 200% after that, Monday to Sunday (clause 20.1), so the first 2 hours of overtime on a Sunday pay less than Sunday ordinary hours. Casuals get the 25% loading added to every penalty, and to overtime as well: 175% for the first 2 hours, then 225% (clause 20.2). Annual leave pay has two parts that are added together: what you would have earned for your ordinary hours, and a 17.5% loading, or your shift penalty instead if you were a shiftworker and it is greater (clause 23.3). Level 1 ($978.10 a week) is below the National Minimum Wage and only applies while you have been in the industry for less than 6 months (clause 12.1(a)). The first aid allowance is written for full-time employees (clause 18.2(d)(i)). The award has no junior or apprentice rates. Employers covered by the Local Government Award, the Manufacturing Award or the Clerks (Private Sector) Award are excluded (clause 4.3).
Each classification has its own pay grade. Use the FWO Pay Calculator for current dollar rates.
