Calculate your leave under this award

The Real Estate Award sets your pay rates, but your paid leave runs on the National Employment Standards. Work out 4 weeks of holidays with the annual leave calculator, and your 10 days of paid sick and carer's leave with the personal leave calculator. Coverage

Who this award covers.

The Real Estate Award (MA000106) is the common name for the Real Estate Industry Award 2020. Industries, work types and exclusions are taken from the Fair Work Ombudsman summary.

Industries

  • real estate agency
  • business and hotel broking
  • strata and community title management
  • stock and station agency
  • buyers agency
  • real estate valuation

Work types

  • residential and commercial property sales
  • leasing
  • property management
  • strata and community title management
  • buyers agency work
  • property valuation
  • listing and auction work

Notes & exclusions. Unusual among modern awards in setting no Saturday or Sunday penalty and no shiftwork clause at all: ordinary hours may be worked on any day of the week (clause 13.1) at 100%, so Saturday opens and Sunday auctions are ordinary time. The public holiday rate is 200% with a 3-hour minimum payment, below the 250% common elsewhere. Overtime is paid at ordinary rates unless it falls on the employee's rostered day or half day off, when it becomes 150% for the first 2 hours then 200% (clause 19.1), and there is no entitlement at all if the employee worked the extra hours at their own initiative. Much of the industry sits outside this grid entirely: a Level 2 or higher employee aged 21 or over who holds a licence or registration, has 12 consecutive months of relevant experience in the last 3 years and can show annual remuneration of at least 125% of their classification rate (the Minimum Income Threshold Amount) may agree in writing to commission-only employment under clause 16.7, which pays a minimum of 31.5% of the employer's gross commission and switches off minimum rates, overtime, most allowances and annual leave loading. Juniors and casuals cannot be commission-only, and the arrangement must cease if the annual review shows gross income below the threshold.

Who does the Real Estate Award cover?
Real Estate Industry Award 2020 (MA000106) covers real estate agency, business and hotel broking, strata and community title management, stock and station agency and related industries. Common roles include residential and commercial property sales, leasing, property management, strata and community title management. Are there Saturday penalty rates under the Real Estate Award?
No specific Saturday penalty rate is set in this award.
Are there Sunday penalty rates under the Real Estate Award?
No. Weekend work is absorbed in the annualised salary structure of this award.
What is the public holiday rate under the Real Estate Award?
FT/PT employees who work on a gazetted public holiday are paid 200% of the base hourly rate (2.00x). Casuals receive 225% (the FT rate plus the 25% casual loading). Employees who don't work the holiday receive their ordinary day's pay if it would otherwise have been a working day.
How many weeks of annual leave do I get under the Real Estate Award?
4 weeks per year of full-time service under the NES, paid pro-rata for part-time. The Real Estate Award does not classify any of its workers as continuous-shift workers under NES s.87(1)(b), so the 5-week shift-worker entitlement does not apply. Calculate annual leave accrual
Is annual leave loading paid under the Real Estate Award?
Yes. 17.5% loading is paid on the minimum hourly rate during periods of paid annual leave. There is no shift-worker variation in this award, so the loading is a flat 17.5% across employee types. Leave loading calculator
What is the casual loading under the Real Estate Award?
25% on top of the base hourly rate, in lieu of paid annual leave, paid personal leave and notice entitlements. Casual loading is added to the FT/PT rate when a casual works any of the penalty-rate hours above (Saturday, Sunday, public holiday, evening, night).
Does the Real Estate Award include rostered days off (RDOs)?
No. The Real Estate Award does not include a formal RDO accrual cycle. Time off in lieu of overtime (TOIL) may still be available where the employer and employee agree, but it works differently from a formal RDO and is not automatically accrued.
Where do I find current pay rates by classification under the Real Estate Award?
Pay rates by classification under MA000106 change quarterly with Fair Work Commission Annual Wage Review decisions. The official source is the FWO Pay Calculator, which always reflects the current rates. Open the FWO Pay Calculator
