Redundancy means your job is no longer needed by anyone; retrenchment means being let go because of it. Australian employment and tax rules set out the entitlements in redundancy terms, so the same notice, NES redundancy pay and tax-free limit apply whichever word your letter uses.
The word itself only changes the money in a few places. A Commonwealth public servant retrenched after 6 years is paid long service leave that a colleague who resigns the same day never gets. A black coal miner can receive up to 30 weeks of retrenchment pay on top of severance, but only for three named causes. This guide sets out what each word means, the four places in Australian law where retrenchment is the word that triggers a rule, and worked examples with 2026-27 figures. Every rule comes from an Australian Act, award or regulator page, with the date it was checked.
Key takeaways
- Redundancy is about the job; retrenchment is about the person. Redundancy is a business no longer needing a job done by anyone. Retrenchment is the compulsory end of someone's employment because the position, the work or the workforce is no longer needed.
- The label on your letter does not change your entitlements. Notice, NES redundancy pay and the tax-free limit depend on why your employment ended. In 2026-27, up to $13,598 plus $6,801 per completed year of a genuine redundancy payment is tax-free.
- Commonwealth employees: with at least 1 but under 10 years of service, retrenchment pays out your long service leave credit. Resigning at the same point pays nothing.
- Black Coal Mining award: retrenchment pay of 2 weeks per completed year, up to 30 weeks, sits on top of severance, but only where the cause is technological change, market forces or diminution of reserves.
- Resigning instead means no NES redundancy pay, no tax-free part, and for Commonwealth employees under 10 years, no long service leave payment.
What each word means
The two words describe one event from opposite ends. Redundancy looks at the position, retrenchment looks at the person who held it, and dismissal is the legal act that ends the employment.
| Word | What it describes | Where Australian sources use it |
|---|---|---|
| Redundancy | The job: the business no longer needs it done by anyone | Fair Work Ombudsman: "Redundancy is when a business no longer needs an employee's job to be done by anyone." Fair Work Act: "redundancy pay" (s 119) and "genuine redundancy" (s 389). ATO: "genuine redundancy payment". |
| Retrenchment | The person: their employment is ended because the position, the work or the workforce is not needed | Long Service Leave (Commonwealth Employees) Act 1976 s 4(1) defines it. Black Coal Mining Industry Award 2020: "retrenchment pay" (cl 34.4) and termination "by retrenchment" (cl 33.4(b)(i)). NSW and Queensland workers compensation Acts list it as management action. Services Australia: "redundancy or retrenchment of 15 or more staff". |
| Dismissal | The legal act: employment ended by the employer's decision | Fair Work Act s 386(1): employment "terminated on the employer's initiative". ATO: "the involuntary termination of an employee". |
The Commonwealth employees' long service leave Act gives retrenchment a precise statutory meaning: "the compulsory termination of the service of the employee for the reason that: (a) his or her service or position is not necessary; (b) the work for which he or she was engaged is finished; or (c) a reduction in the number of employees is necessary because the quantity of work has diminished."
Set that beside the redundancy pay trigger in s 119 of the Fair Work Act, where the employer "no longer requires the job done by the employee to be done by anyone". The two are separate laws with their own tests, but in practice they point at the same kind of exit: you did not choose to leave, and the reason is the work, not you.

Is retrenchment the same as redundancy?
For notice, redundancy pay and tax, yes. Each entitlement turns on why your employment ended and who decided it, not on the word in your termination letter.
Notice. Before ending your employment, your employer must give you written notice of your last day, whatever the reason: 1 to 4 weeks depending on your service, and an extra week if you are older than 45 and have 2 or more years of continuous service. How that works when your role is abolished, including pay in lieu, is covered in redundancy notice.
NES redundancy pay. Section 119 pays redundancy pay when your employment ends at your employer's initiative because it no longer needs your job done by anyone, or because the employer is insolvent or bankrupt. You need at least 1 year of continuous service, cover by the national workplace relations system, and an employer with at least 15 people. Awards and enterprise agreements can also set redundancy pay.
Tax. The ATO's tax-free treatment is for a genuine redundancy payment: your job is abolished and you are under age-pension age. It does not apply if you leave voluntarily, your contract ends, you reach normal retirement age, or you are dismissed for disciplinary or inefficiency reasons. In 2026-27 up to $13,598 plus $6,801 for each completed year of service is tax-free. What happens above that is in redundancy tax and the tax-free limit.
Unfair dismissal. A genuine redundancy cannot be challenged as an unfair dismissal. When a redundancy fails that test is set out in genuine redundancy.
Final pay. Payment in lieu of notice, redundancy pay and accrued or pro rata long service leave are separate items in your final pay, alongside wages and annual leave owing. Unused sick and carer's leave is not part of it. The final pay calculator puts the items together.
Enter your weekly pay and years of service in the redundancy calculator to see your NES redundancy pay and how much of it falls under the 2026-27 tax-free limit.

"If it applies, final pay can also include: payment in lieu of notice; redundancy pay; accrued or pro rata long service leave." "Sick and carer's leave isn't paid out when employment ends."
Where the word retrenchment changes your pay
Four Australian instruments use retrenchment as the word that triggers a rule. Two of them change the amount you are paid. One decides whether a stress claim is payable, and one sets what an employer must tell Services Australia.
Commonwealth employees' long service leave
If you leave a Commonwealth job with at least 1 year but less than 10 years of service, the way you leave decides whether your long service leave credit is paid. Retrenchment is one of the reasons listed in s 17(2) of the Act, so the credit is paid out in money. The approving authority may instead grant it as leave on full salary, timed to end immediately before your last day (s 17(1)). Resignation is not on the s 17(2) list, so resigning in the same window pays nothing.
The credit is 3a/10 months, less any of it already used, where a is your service in years (s 18(1)(a)). That is 0.3 months for each year. Priya's example below shows the gap on one salary, and the Commonwealth employees long service leave calculator has a retrenchment option alongside resignation, retirement, ill health and death.
Black Coal Mining award: retrenchment pay on top of severance
The Black Coal Mining Industry Award 2020 runs "an industry-specific redundancy scheme", so the NES redundancy pay scale does not apply to the employees it covers (cl 34.1). The scheme pays in two layers:
- Severance: one ordinary week's pay for each completed year of employment (cl 34.3).
- Retrenchment pay: 2 ordinary weeks' pay for each completed year, up to 30 weeks, paid in addition to severance, but only where the cause is technological change, market forces or diminution of reserves (cl 34.4(a)). The 30-week cap is reached at 15 completed years.
Under this award, then, retrenchment pay is not another name for redundancy pay. It is a second payment with its own trigger. The award uses the word again for personal leave: an employee whose employment ends by retrenchment (or by retirement at or after 60, by the employer because of ill health, or by death) and who has 70 or more hours of untaken personal leave receives a personal leave payout under cl 33.4(b)(i). That is an exception to the general rule that sick and carer's leave is not paid when employment ends. Pay rates and the rest of the award are on Black Coal Mining Award pay rates.
Workers compensation for stress claims
In NSW, management action includes "demotion, redeployment or retrenchment" (s 8F(c) of the Workers Compensation Act 1987), and no compensation is payable for a psychological injury if its significant cause was reasonable management action taken or proposed by the employer (s 11A(1)). Reasonable management action means action "taken in a reasonable way" that "is reasonable in all the circumstances" (s 8F).
Queensland's Act says an injury does not include a psychiatric or psychological disorder arising out of reasonable management action taken in a reasonable way, and the Act's example names action to "retrench" the worker (s 32(5)). Retrenchment is named in both lists, so a stress claim that rests on the retrenchment itself runs into this exclusion. How stress leave is paid otherwise is covered in stress leave in NSW and stress leave in QLD.
Services Australia notice when 15 or more go
Services Australia tells employers: "If you're considering redundancy or retrenchment of 15 or more staff, you need to give us written notification." The legal duty sits in s 530(1) of the Fair Work Act: an employer that decides to dismiss 15 or more employees "for reasons of an economic, technological, structural or similar nature" must give written notice to Centrelink. This is an employer obligation and does not change what each employee is paid. Services Australia also says it can organise information sessions for staff facing redundancy. The steps are in making 15 or more employees redundant.
Retrenchment vs resignation, dismissal and voluntary redundancy
What moves the money is who ended the employment and why. These are the exits most often confused with retrenchment.
| How the job ends | Who decides | NES redundancy pay | Tax-free part | Commonwealth LSL, 1 to under 10 years |
|---|---|---|---|---|
| Retrenchment or redundancy | Your employer, because the job is not needed | Yes, with 1 year of continuous service, national system cover and an employer of 15 or more | Yes, up to the limit, if the ATO conditions are met | Paid (s 17(2)(b)) |
| Voluntary redundancy | Your employer, choosing from volunteers | See voluntary redundancy | Yes, if the final decision stays with your employer | Not covered here |
| Resignation | You | No: s 119 needs a termination at the employer's initiative | No: "leaving voluntarily" | Not paid |
| Dismissal for conduct or performance | Your employer, but the job is still needed | No: the job is still needed | No: "disciplinary or inefficiency reasons" | Not paid: dismissal is not in s 17(2) |
In the Fair Work Ombudsman's glossary, voluntary redundancy is "When redundancy is offered by an employer and is voluntarily accepted by an employee." For tax, the ATO accepts that putting your hand up does not stop it being a dismissal: "In circumstances where an employee volunteers to accept a redundancy package, there may still be a dismissal. This will occur where the decision to terminate employment is still ultimately that of the employer."
Section 386(1)(b) of the Fair Work Act treats a resignation forced by the employer's conduct as a dismissal, which matters for an unfair dismissal claim.
Worked examples
Wages and salaries are illustrative. Figures use s 117 and s 119 of the Fair Work Act, the ATO's 2026-27 tax-free limit, the Commonwealth employees' long service leave Act and the Black Coal award, as cited above.
Sarah is 50 and has worked full-time since Monday 24 February 2020 for an employer with 60 staff. On Friday 13 November 2026 she gets a letter saying she is "retrenched" because her role has been abolished. Her base rate is $1,500 a week.
- Notice: more than 5 years of service gives 4 weeks. She is older than 45 and has more than 2 years of continuous service, so add 1 week: 5 weeks.
- NES redundancy pay: 6 to under 7 years is 11 weeks. 11 x $1,500 = $16,500.
- Tax-free limit, 2026-27, 6 completed years: $13,598 + (6 x $6,801) = $13,598 + $40,806 = $54,404. The $16,500 is well inside it, so it is tax-free if the ATO's genuine redundancy conditions are met.
Had the letter said "made redundant", every figure would be the same.
Priya is a Commonwealth employee who started on Wednesday 1 July 2020. Her last day is Friday 30 October 2026, on a salary of $88,000.
- Service: 75 completed months, so a = 75 / 12 = 6.25 years.
- Credit: 3 x 6.25 / 10 = 1.875 months.
- If she is retrenched: the credit is paid. $88,000 x 1.875 / 12 = about $13,750. The approving authority may instead grant it as leave on full salary ending just before her last day.
- If she resigns the same day: $0, because she has less than 10 years and resignation is not a reason listed in s 17(2).
The Commonwealth employees long service leave calculator runs the same figures for your own dates and salary.
Wes is a Mineworker under the Black Coal Mining award with 9 completed years, and his role ends. The weekly figure used here is the award minimum for a Mineworker, $1,187.80 a week, as an illustration only.
- Severance (cl 34.3): 9 x $1,187.80 = $10,690.20.
- If the cause is technological change, market forces or diminution of reserves, retrenchment pay is added (cl 34.4(a)): 2 x 9 = 18 weeks. 18 x $1,187.80 = $21,380.40.
- Total in that case: 9 + 18 = 27 weeks. 27 x $1,187.80 = $32,070.60.
- If the cause is something else: severance only, 9 weeks, $10,690.20.
The NES scale's 16 weeks at 9 years does not apply, because the award's own scheme replaces it (cl 34.1). At 9 years Wes is well short of the 30-week retrenchment pay cap.
Take the same Sarah, but on Friday 13 November 2026 she resigns to start a new job.
- NES redundancy pay: $0. Section 119 needs a termination at the employer's initiative.
- Tax-free part: none. The ATO excludes a payment where you are "leaving voluntarily".
- Notice: she gives notice instead of receiving it. Under the General Retail Industry Award, for example, an employee gives the same notice an employer would except for the extra week based on age: 4 weeks at her service, not 5. Her own award or contract sets her actual period, and resignation notice period covers the rules.
- If she were a Commonwealth employee: with under 10 years of service, no long service leave payment.
Retrenched, Sarah receives $16,500 in redundancy pay plus 5 weeks of notice or pay in lieu. Resigning on the same day, she receives no redundancy pay.
Common questions
What is the difference between redundancy and retrenchment?
Redundancy describes the job: the business no longer needs it done by anyone. Retrenchment describes what happens to the person who held it: their employment is ended because of that. The Commonwealth employees' long service leave Act defines retrenchment as a compulsory termination because the role is no longer necessary, the engaged work has ended, or the workforce must shrink because there is less work. Your notice, redundancy pay and tax follow the redundancy rules.
Is retrenchment the same as redundancy?
For your notice, NES redundancy pay and tax-free limit, yes. Those depend on why your employment ended, not the word used. Retrenchment works differently in four places: Commonwealth employees' long service leave, the Black Coal Mining award, NSW and Queensland workers compensation, and Services Australia's notice for 15 or more staff. See where the word retrenchment changes your pay.
Is it better to resign or be retrenched?
This guide does not give advice, but the differences are fixed. If you resign, you get no NES redundancy pay, no tax-free part, and you give notice rather than receive it. A Commonwealth employee with under 10 years also loses the long service leave payment. In Sarah's example, retrenchment pays $16,500 in redundancy pay and resignation pays nothing.
How much redundancy will I get after 40 years of service?
Under the NES, 12 weeks. The scale peaks at 16 weeks for 9 to under 10 years and falls to 12 weeks once you reach 10 years; longer service does not add to it. An award or enterprise agreement can pay more. The 2026-27 tax-free limit at 40 completed years is $13,598 + (40 x $6,801) = $13,598 + $272,040 = $285,638.
What does retrenched mean?
Being let go by your employer because your job, the work you were engaged for, or the number of staff needed has gone. The Commonwealth employees' long service leave Act puts it as "the compulsory termination of the service of the employee" for one of three reasons: the position is not needed, the engaged work is done, or the quantity of work has fallen so fewer employees are required.
What are retrenchment entitlements in Australia?
The same as for redundancy: written notice of 1 to 4 weeks (one more if you are older than 45 with 2 or more years of service), or pay in lieu; NES redundancy pay if you have 1 year of continuous service, national system cover and an employer of 15 or more; wages and annual leave owing; long service leave where it applies; and a tax-free part up to the 2026-27 limit. Sick and carer's leave is not paid out.
Is retrenchment pay taxed differently from redundancy pay?
No. The ATO's test asks whether your job was abolished and the other genuine redundancy conditions are met: under age-pension age, not leaving voluntarily, not a contract end, not a disciplinary dismissal. If they are, up to $13,598 plus $6,801 per completed year is tax-free in 2026-27. A non-genuine payment is taxed as an ETP. See redundancy tax and the tax-free limit.
Is there a retrenchment calculator?
Use the redundancy calculator for NES redundancy pay and the tax-free limit. It applies the NES scale, so if your award runs its own scheme, as the Black Coal Mining award does, work from the award clause instead. Commonwealth employees can use the Commonwealth employees long service leave calculator, which has a retrenchment option.
What is the difference between redundancy and termination?
Termination is the general word for employment ending. Redundancy is one reason an employer ends it: the job is no longer needed by anyone. Dismissal for conduct or performance is another, and it carries no NES redundancy pay because the job is still needed. Who must give notice, and how much, is in notice of termination.
What are the downsides of retrenchment?
Your income stops, and a redundancy payment can delay Centrelink: Services Australia says an income maintenance period "may apply if you or your partner have stopped work and got leave or redundancy payments." Your unused sick and carer's leave goes unpaid (the Black Coal award is one exception, above). For unused long service leave, check the rules that apply to you in pro-rata long service leave.
